These rules describe the requirements a listing on https://www.pedalia.at must meet. They supplement the General Terms and Conditions.

We do not review every listing in advance. Responsibility for the content of a listing always rests with the advertiser, both before and after publication. These rules set out what we look at when we do review a listing, and which grounds lead to a request for revision or to removal.
1.1. These Listing Rules apply to all listings, images, videos, profile and shop content on the platform, whether posted by private individuals or by commercial providers.
1.2. They form part of the General Terms and Conditions. A breach of these rules is a breach of the GTC.
2.1. A listing must relate to a specific item that is actually available. Listings that merely seek items, offer swaps, or advertise without a specific offer are not permitted.
2.2. The title and description must accurately identify the item offered. Brand, model, frame size, wheel size, condition and any known defects must be stated truthfully.
2.3. Listings must be placed in the appropriate category. Deliberately choosing the wrong category to increase visibility is not permitted.
2.4. Only one active listing may exist for the same item. Several similar items must be listed individually where they are sold individually.
2.5. Once an item is sold it must promptly be marked as sold, or the listing deactivated.
2.6. Content created wholly or predominantly using generative artificial intelligence, in particular images, must be labelled as such. An AI-generated image may not take the place of a real photograph of the product.
3.1. The price field must be completed with the actual sale price. State the Austrian gross end-consumer price in euro, including VAT and all other taxes and charges.
3.2. The price stated must be the price at which the item is actually sold. The following are not permitted in particular: entries such as “make an offer”, “o.n.o.”, “price on request” or “from”; leasing, instalment, monthly or financing amounts; net prices; prices for individual parts of a combined offer; placeholder amounts such as 1 euro or 999,999 euro.
3.3. Additional costs that necessarily arise, in particular shipping, assembly or service charges, must be stated clearly and in full in the description.
3.4. Price information in the title, description or images must not contradict the price field. In the event of a contradiction, the price field governs.
3.5. Commercial providers must additionally comply with the Price Marking Act and with consumer protection provisions, in particular as regards unit prices and the announcement of price reductions.
4.1. A price reduction may be announced exclusively via the promotional price function. That is the only way to ensure the comparison price displayed meets statutory requirements.
4.2. The comparison price used is automatically the lowest price the listing carried on the platform within the 30 days preceding activation of the promotion. No other comparison price can be set.
4.3. A promotion can only be set once the listing has been active continuously at its previous price for at least five days. It ends automatically after 14 days, after which the promotional price applies as the regular price. A promotion can be ended early at any time.
4.4. Outside the promotional price function, statements of reduction or comparison are not permitted. This includes in particular struck-through prices, percentage figures such as “20 per cent off”, wording such as “instead of”, “previously”, “RRP”, “list price” or “when new”, and price comparisons with other providers, whether in the title, the description or in images.
4.5. Repeated price increases immediately before a promotion, intended to inflate the comparison price artificially, are treated as misleading price information.
5.1. Use your own, current photographs of the item actually offered. Catalogue, manufacturer or stock images may not take the place of a real photograph of the product.
5.2. The advertiser must hold all necessary rights in the images and videos uploaded. Taking images belonging to others — for example from manufacturer or dealer sites, from online shops or from other listings — is not permitted without the rights holder's consent.
5.3. Images must not contain watermarks, logos, contact details, price information, discount stickers, advertising banners or references to other platforms.
5.4. People may only be shown with their consent. Vehicle registration plates, house numbers and other personal data of third parties must be obscured.
6.1. Anyone who lists regularly, in significant volume or with the intention of making a profit counts as a commercial provider. This applies irrespective of whether a trade licence is held or tax liability arises.
6.2. Commercial providers require a commercial account and the listing products designated for it. Commercial listings placed through a private account are not permitted.
6.3. Commercial providers must state their company details in full and meet consumer information duties, in particular as regards the right of withdrawal, statutory warranty and price marking.
6.4. Whether a provider is private or commercial is shown on every listing and is available to searchers as a filter.
7.1. Listings for stolen, counterfeit, imitation or non-marketable goods, and for items whose sale is prohibited or restricted by law, are not permitted.
7.2. Content that infringes a statutory prohibition or public morals is not permitted, in particular content that is insulting, discriminatory, glorifies violence, is harmful to minors, or is otherwise unlawful.
7.3. Content that infringes third-party rights is not permitted, in particular copyright, trade mark, business identifier and personality rights.
7.4. Advertising on behalf of third parties, chain letters, pyramid and referral schemes, and references to competing platforms are not permitted.
7.5. For e-bikes and pedelecs, information on the battery, motor and range must be truthful. Manipulated drive systems, removed speed limiters and so-called tuning kits are not permitted.
8.1. Contact details, in particular telephone numbers, email addresses and links, belong in the fields provided for them, not in the title, description or images.
8.2. The platform's contact function may not be used for advertising, bulk messaging or offers unrelated to the listing concerned.
9.1. Where a breach can be remedied, we place the listing in the status “revision required”. It is then no longer publicly visible but remains editable. We state the reason. Once it has been amended, the listing is reviewed again.
9.2. In the case of serious or repeated breaches we may remove the listing, restrict functions or suspend the account. Where price information is misleading we take the listing offline with immediate effect.
9.3. These are the grounds we use:
9.4. A complaint may be lodged against a decision within six months of receipt of the statement of reasons. Recourse to the courts remains unaffected.
10.1. Anyone who considers a listing unlawful or in breach of these rules can report it to us using the reporting function or the contact details given in the Imprint.
10.2. We handle reports promptly, do not decide on a solely automated basis, and inform both the reporting person and the advertiser concerned of the outcome.
